1. Acceptance of Terms
By accessing this website or engaging the services of Navabharatha
Sustainable Organization, you agree to
be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our
website or services.
2. Scope of Services
Navabharatha provides the following services:
- ZED Certification Services: Assistance in obtaining
Zero Defect Zero Effect (ZED)
certification under the Government of India's MSME initiative.
- ZED Consulting: Professional guidance to help
businesses prepare for ZED
certification, including process improvements, documentation, and compliance requirements.
- ZED Assessment: Evaluation of a business's quality
systems, processes, and
environmental practices to determine readiness for ZED certification.
- ISO Certification: Assistance with ISO certification
processes (Coming Soon).
- ISI Certification: Support for BIS/ISI certification
(Coming Soon).
- FSSAI Certification: Food safety licensing and
certification support (Coming Soon).
- Business Consulting: General business consulting
services (Coming Soon).
- Software Solutions: Custom software development
services provided through
Navabharath Technologies.
Specific project details, including scope, deliverables, timelines, and
fees, will be governed by a
separate Service Agreement or Statement of Work (SOW).
3. Client Responsibilities
Clients engaging our services agree to:
- Provide accurate and complete information required for
certification/consulting processes.
- Grant timely access to facilities, documentation, and personnel as
needed for assessments.
- Respond promptly to queries and feedback requests to ensure project
timelines are met.
- Implement recommended improvements and corrective actions in good
faith.
Delays caused by the client in providing necessary information or access
may result in schedule and cost
adjustments.
4. Certification Disclaimer
Important: Navabharatha assists clients in preparing for
and applying for certifications
(ZED, ISO, ISI, FSSAI). However, the final certification decision is made solely by the respective
certifying authority (e.g., QCI for ZED, BIS for ISI). We do not guarantee certification approval, as
this depends on the client's actual compliance with the certification standards.
5. Payment Terms
- Invoicing: Payment terms, including any advance
deposits and milestone payments,
will be outlined in the Service Agreement.
- Late Fees: We reserve the right to charge interest on
overdue payments as specified
in the agreement.
- Refunds: Advance payments and deposits are generally
non-refundable once work has
commenced, unless otherwise specified in the agreement.
6. Confidentiality
Both parties agree to maintain confidentiality of proprietary information
shared during the engagement.
This includes business processes, financial data, trade secrets, and any other sensitive information
disclosed during the consulting or assessment process.
7. Intellectual Property
Client Materials: All documents, reports, and deliverables
prepared specifically for the
client become the client's property upon final payment.
Navabharatha IP: Any templates, methodologies, frameworks,
and proprietary tools used in
our consulting process remain the property of Navabharatha.
8. Limitation of Liability
Our liability is limited to the fees paid by the client for the specific
service. Navabharatha shall not
be liable for:
- Certification denial by the certifying authority.
- Indirect, consequential, or incidental damages, including loss of
business or revenue.
- Delays or failures caused by circumstances beyond our reasonable
control.
9. Termination
Either party may terminate the service agreement under specific
conditions, including:
- Material breach of contract by the other party.
- Non-payment of fees beyond the agreed grace period.
- Mutual written agreement.
Upon termination, the client shall pay for all work completed up to the
termination date.
10. Indemnification
The client agrees to indemnify and hold Navabharatha harmless from any
claims, damages, or liabilities
arising from:
- Inaccurate or incomplete information provided by the client.
- The client's failure to implement recommended improvements.
- Any third-party claims related to the client's business operations.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance
with the laws of Karnataka, India.
Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in
Mysore, Karnataka.
12. Changes to Terms
Navabharatha reserves the right to update these Terms and Conditions at
any time. The latest revision
date will be indicated on this page. Continued use of our services after changes constitutes acceptance
of the updated terms.
